In Cali, Kris Humphries is the presumed dad of Kim K.'s babyKanye was a proud father on Sunday night when he announced that he and girlfriend Kim Kardashian are expecting a baby, but he'd have to do more than claim her as his "baby mama" for the state of California. As TMZ's noted, in the eyes of the state's Family Code, Kardashian's estranged husband, Kris Humphries, is presumed to be the father of her baby because the two are still legally married. Kardashian filed for divorce in October 2011 after 72 days of marriage, but it's not yet official. A man is presumed to be the natural father of a child if he is or has been married to the mother, and if the baby is born during the marriage or within 300 days after death, annulment, declaration of invalidity, divorce or after a judgment of separation is entered by the court. Humphries filed for an annulment and separation from Kardashian on December 1, 2011, but a judgment of separation hasn't been granted, making him the presumed dad. Anyone involved can clear up the paternity with "clear and convincing" evidence, such as a DNA test.

See guys, this is what happens when you marry the wrong woman. You have to deal with all this cr...p for years and years. My recommendation: date her for three to five years. If she does not really love you, she won't date you for more than a year, then she will dump you or you will dump her. And, before marrying her A PRENUP IS A MUST. California Family Code Sec. 7540 says "the child of a wife cohabiting with her husband, who is not impotent or sterile, is conclusively presumed to be a child of the marriage." Because Kim is not cohabiting with her husband Chris, he will not be presumed to be the father of her child.

The law in many states (California and Florida among them) makes it an "irrefutable presumption" that the husband of a married woman is the father of the child – regardless of DNA or any other evidence – and thus makes that husband/(non)father responsible for the rearing of the child (i.e. child support). This archaic concept was established to prevent husbands in days gone by from skipping out on child support obligations. These laws need to be changed to reflect the adoption (pun intended) of modern DNA methods of nailing down (again, pun intended) the real father.
It's true in many states, mine included, and I'm not in California or Florida. It's a good law. Without it, anyone can decide they don't want a baby and/or don't want to support and baby and just try the slu t-shaming route and claim that she cheated. It's not remotely archaic. Getting a DNA test while the baby is in the womb is invasive and can cause a miscarriage. IF you're married, it's your kid at least until it's born.

It's not messed up. That is the law in many states and it's that way for a reason, which is to ensure that a child will be financially supported. If the husband can prove by DNA testing that he is not the father, he can get the child support order revoked.
If you look at it from the standpoint of protecting the baby and not just about some silly woman who couldn't keep her legs closed until she was divorced, it makes complete sense.

This is a case of "Mama's baby and Daddy's maybe" and I don't think a court can force a woman to have the baby DNA tested, or can they.
If the mother sues for child support of the husband and the husband contests the parentage, then the husband can seek to challenge on the basis of adultery committed by the mother, notorious adultery in this case. If the mother files legal papers admitting adultery and denying consummation of the marriage, then the marriage can be invalidated without issue. The husband should seek to have things determined legally now instead of waiting for the future possibility that the child will seek to inherit from the father's estate.

In my opinion, if you look back at earlier photos of Kim, she is flat wrecking her good looks by all the Botox enhancement of her lips and God knows what else her face is getting let alone the rest of her. All she does is take away from her normal good looks. I would like to read about what she does in this world to really help others in need instead . I am also embarrassed at how this gossip affects Kris Humphries, his family, and his friends. I would rather read about the charities the Kardasians support and the work they have contributed to situations like Hurricane Sandy, or contributions they make toward human trafficking, etc. In other words, not the trash we read about this family in all the tabloids and especially when they run these articles which have no substance whatsoever. I believe in NY (and/or PA) if a married woman has a child with someone other than her husband, the husband is legally the child's father. Last I checked, not even DNA evidence can reverse this 'presumed paternity', meaning that the woman's husband would be responsible for child support even if there is evidence to the contrary! No. . . that's why it is call "presumed" paternity. . . that presumption can be overcome with convincing evidence like DNA. . . the law uses the parental presumption to ensure that the child has legal right to support from 2 people rather than 1 and is less likely to become a burden on the state for support. . . if you can show that someone else has that responsibility, (again with something like dna) you are off the hook. . .
My point was that some states do not allow for DNA as 'clear and convincing' evidence. Just look it up. It's bizarre but true.

Sorry to disappoint you, Noname, but none of my earlier statement is incorrect. The mother may NOT put any name she wants to on the birth certificate – the birth certificate clerks at the hospital have all of her information in front of them & they are very well aware of her marital status before they have contact with her. The hospital has state laws that they must abide by & the mother has no choice when it comes to state laws. It's only after she leaves the hospital that the biological father can have DNA testing & have his name added to the birth certificate. The man she is legally married to has the same option – if she puts him on the birth certificate, he can also have DNA testing & have his name removed. One more thing I might add, courts can & do order DNA testing.
Not only can she put any name she wants, she doesn't even have to get one if she doesn't want one.

Actually, you can put any last name you like on a birth certificate. I know lots of people who put the surname of their presumed baby daddy on the bc even though they are not married and I know at least one woman who was estranged from her husband and put her lover's name on the birth certificate and no one bothered her about it–they broke up later, but the baby still has her daddy's last name.

Any child born during a marriage is the legal offspring of the 2 people who are married, & someone else's name cannot be put on the birth certificate until it can be proven later that he is the father of the baby. At the time of birth, the mother may refuse information instead of putting her legal husband's name on the birth certificate, & until then, the father's name is left blank. It protects the rights of both people who are legally married.

Actually part of you statement is not true. The only one who is allowed to fill out the birth certificate is the mother, because the hospital knows for sure that they are the mother. The mother can add any name she wants on the birth certificate, or if she wants she can leave it blank. The only way to dispute you name on the birth certificate, or not on the birth certificate is a DNA test.

Paternity in California doesn't even come into effect until the baby is born. Afterwards whether you are married or not, whoever signs the paternity papers gets to have claim to the child until actual paternity via DNA is proven. This article is a bunch of BS.

If Kanye doesn't provide evidence to the court that he's the father (DNA test), then yes, Kris could sue for visitation rights (though I can't imagine he'd want to). I doubt he'd get any child support though, since the child would not be living with him. I also don't think he's hurting for cash.
