Amanda Bynes: Mr. President, can you fire a police officer?We know President Barack Obama ran on the "Yes, we can" platform, but we're not sure that extends to firing a police officer per a starlet's request. Actress Amanda Bynes tried her luck anyway, asking the president via Twitter if he could get rid of the officer who arrested her on suspicion of driving under the influence in April. The 26-year-old was booked and later released after she got into a fender-bender with a marked black-and-white patrol car while driving her black BMW around Hollywood. She was officially charged with driving under the influence on June 5, which perhaps prompted her to reach out to POTUS: "Hey @BarackObama," she wrote Tuesday. "I don't drink. Please fire the cop who arrested me. I also don't hit and run. The end." Bynes reportedly entered a not guilty plea at an arraignment on Wednesday, which sounds about right, seeing that she issued a similar statement on her Twitter account at the end of May. "I was not in any hit and runs," she wrote. "I don't drink so the DUI is false." The president (or his staff) has yet to tweet a response.

Operating a vehicle is a privilege. Your license states you agree to any sobriety test. Failure to do so results in punishment. Everyone who drives knows this its the law. Just because she used to be somewhat famous does not give her the right to break the law. Messaging the President about her situation is just plain old stupidity.
Your license does not state you are required to take a soberity. In fact if she just remained silent during the whole incident and just got a ticket, the officer could do nothing. She could fight the ticket just based on the ticket instead of what she said to the officer. You and not required by law to speak to an officer during a traffic stop. The goal of the officer is to get you to admit to a crime. If you ever think you have had one too many to drink, you can always decline a field soberity test and request for blood work at the station. Yes it will kill your evening but by the time the blood work is done you are more than likely under the limit and not getting a DUI.

Yes, you can refuse a breath test, but at least in the State of Washington, your license will automatically be suspended for six months if you do so. It's called Implied Consent, as when you get your license you agree to take a breath test if arrested for DUI. No, it's not in big letters on the front of your actual driver's license; that's why they say to read the small print. And to all of you who say the police should leave the drunks alone and handle "important" crimes, your tone will change completely if one of your loved ones is killed by a drunk driver. Of course, that presumes you HAVE loved ones . . .

Back a number of years ago, there was a police stopping of vehicles and drivers were given a breath test. I was one who was stopped, failed the breath test by a small margin. After a few procedures there were about fifteen of us gathered in a room, a young lady asked for each of us to give the details of our DUI incident. I was one of the last to offer my drinking details. Everyone who was questioned, all who had been drinking nothing but beer, said they had one or two drinks, one said he had one but did not finish it. When it was my turn I said I had drank six or seven whiskys. Everyone in he room turned to look at me, giving the impression, "Who let the drunk in here?" It was a first learning for me how people react. It appeared I was the only one in the room who had really been drinking more than a bit, but we had all been charged with DUI. This was back in the 70's, my sentence was to attend drunken drivers school one day a week for six weeks, was then given a reckless driving citation instead of a DUI. Things are different these days but I am sure most who are charged say they are innocent.
This is what happens with the disgusting mindset of Hollywood. Nuts like this think they are above the law and expect special treatment from the law and government. This is another Disney creation who is going to end up like another famous tradgedy, Miss Lohan.

While the President does not have direct authority to fire a city police officer, he can draw attention to the situation so the city takes action or the officer wants to quit. After all, he drew attention to the Travon Martin shooting and the Henry Louis Gates arrest, both state matters. The real issue isn't whether the president could or would do it, but rather whether Ms. Bynes bundles enough campaign contributions that he will listen to her.

I used to work in a 24 hour gas station, and at one point we got word from on-high that we had to stop giving away free coffee and pastries late at night. The cops spent the next several months sitting in the parking lot all night threatening us with fines and firing every time a drunk person came in the store "go ahead, sell to him, I'd love to take you in and see you get fired." They even gave a group of 19 year old college students fake IDs to try and get us in trouble.

Only people who are over the legal limit refuse the breathalyzer. If you were not over the limit you'd be glad to take the test so the officer COULD NOT arrest you for driving while intoxicated. Had she been alcohol free and taken the breathalyzer, she'd have proof that she wasn't drinking. Now she doesn't.

Has it been reported she refused a breathalyzer? I'm sure most cops in LA are carrying them (though I suppose he might not have conducted one or didn't have it with him for some reason) but I've lived places (like where I grew up) where the cops don't have them; too expensive for the small towns. They would have to drag you to the station to conduct the tests (and again this is small towns so that might be an hour or more drive in the first place) and so sometimes they just say "well I think you might be drunk so that's good enough." Depending on the district you live in, that might even be good enough for the judge.

Driving under the influence doesn't necessarily mean it was due to alcohol, it can be due to other drugs. So just because you don't drink doesn't mean you can't be under the influence of drugs.
And just because a cop issues you a ticket for hitting his car doesn't mean he isn't just trying to cover his butt for causing the accident either.
