James Deen on California measure requiring condoms in porn

The adult film industry is in a bit of a pickle after Measure B, requiring performers to wear condoms while filming, passed in Los Angeles County on Tuesday.

Many people involved with the porn industry have spoken out against the ordinance, including 26-year-old adult film star James Deen, who stars alongside Lindsay Lohan in Bret Easton Ellis' “The Canyons,” due out in 2013.

“I am disappointed. Not particularly about the law but about my community of adult entertainers being continually bullied and used by others,” Deen told The Huffington Post in an e-mail.

“We are much like the homosexual, minority or female populations,” he continued. “We are a community of tax-paying and law-abiding voters who are currently being persecuted. But our opinions do matter, and I hope one day we get respect as these previously-stated groups and others have begun to receive.”

According to Smartvoter.org, the controversial ordinance also states that producers must apply for a permit from the Los Angeles County Department of Public Health and pay a fee to offset the cost of enforcement.

“Are examinations going to be mandatory now, or are we going to be wearing gloves on set?” Deen told The Daily Beast. “I mean, what about goggles? What about kissing and fluid exchange? Is kissing no longer allowed in pornos? Like, what degree of severity is this measure actually going to require? After that, is it worth it?”

Depending on what happens with Measure B (Adult Video News reported that it will probably be challenged in court), Deen said it might be worth it to take the industry elsewhere.

“Is it worth it to migrate to Las Vegas, which is said to be welcoming with open arms?” he asked. “Florida, and I believe Arizona as well, said something about wanting the billion-dollar industry. That’s going to be a huge hit to Los Angeles.”

    I'm actually for this law.

    While the spreading of HIV isn't commonplace in the porn industry, there is a significant thread of that, and other STDs being spread on set. The additional cost of this will be next to nothing, so I don't see a reason not to use it.

      The porn industry regulates themselves quite well on STD and HIV. I would bet the percentages are a fraction of the general population when it comes to STD's in their industry. Maybe the focus needs to be on the public and not the smaller group of actors/actresses. All this will do is drive them out of LA and into another city who will reap the benefits of a larger tax payday.

    Whine, whine, whine. This is an industry with routinely abused employees, and the big name stars can't envision anything getting in the way of their big screen debues. Here's the reality, Princess. The porn industry is an INDUSTRY, the same as any other business, and we regulate ALL business. You are not being oppressed being told to wear a condom, no more than the construction worker is oppressed by being told to wear a hard hat. Your industry refused to police itself, forcing external regulation to happen to defend your own employees. Chew on that flavored condom for a while and think on it a little, yes? Disease and infection rates are rampant in your business, and if you don't protect your employees, WE WILL.

    It's not just the adult industry Los Angeles has largely driven off the entertainment industry. It's too expensive and too much of a hassle to shoot there. So they've already driven off billions a year in business so what's another billion? It's not like they need the tax dollar! Las Vegas is probably a perfect fit since they are struggling. I'm neither for or against I just feel we have bigger problems than regulating morality. The performers are already regularly tested so it's not the health issue they make it out to be it's more about putting them under their thumb and many I'm sure hope it will drive out the industry.

    All this fuss over this and all they would have to do to get around it is move their movie studios to another county. Then Measure B wouldn't apply to them anymore, the new county would be happy to get all the taxes that LA County no longer gets, and LA County would realize that they lost all that tax revenue and what fools they were in the first place and repeal the law in an effort to get them to come back and then the porn industry would politely tell them to go do something to themselves that is physically impossible. (If you catch my drift...)

    I think if the actor wants to use a condom let them if not only work with other actors who share your view. I thought they police themselves because I saw a film a few year ago about the adult industry and how they make each actor get tested before they are allowed to work on a new film. If this isn't working then something else needs to be put in place. I can see the government HELPING them come up with other measures to ensure the actors safety but TELLING them what to do isn't the answer. If California enforces this law then I think the porn industry should move to another state. People watch porn not because of it's moral values but because it's PORN!!!!!!!!!!!!!!!!!!

      The requirement of the condom is likely not so much the big deal as the getting a permit which in turn pays for the enforcement of the law. So the county basically just made the industry not only have to start doing something they didn't want to, but also is making them pay for all the overhead to enforce it. Now first of all I think that's pretty friggen low. You saddle the very industry with the cost of it? When yes they could indeed go somewhere else and not get that cost. If they choose to protect themselves or not is up to them, but force them to pay for a law you just shoved down their throats.. that's just bad form. If LA County wanted them out it looks like they have gotten their wish.

    Don't even go there, dude. None of those are by choice. You are a PROFESSION and you can compare yourself to other PROFESSIONS, some of which are under assault by legal policies, but you are NOT like ho.mose.xual, minority, or female populations who have no choice in who they are. You can change professions if you don't like it or make valid comparison to other job situations, but you don't get to cast yourself in some false civil rights struggle of equality. The government can, and routinely does, make health and safety rules for workplaces–into which condoms on po.rn sets clearly falls. This is nothing different than other health and safety regulations.

    By the way, I don't necessarily agree with the proposition, but I won't stoop to false comparisons to condemn it, either.

    Remember, one primary factor for the very existence of this industry (and others of similarly questionable repute) is the zeal with which conservatives tried to keep the lid on Pandora's Box, so to speak.       What a great argument – if you have a problem with the porn industry, you must be a secret porn watcher.

      The problem is this: in ALL other industries which involve bodily fluids and contact with naked people in any context, there are extremely strict guidelines about wearing gloves and protecting the worker from bloodborne pathogens. What is happening is that the porn industry is exposing themselves to HUGE lawsuits when someone lies about disease status.

      If everyone is forced to get monthly blood tests and physical exams, there would be no need for protections. No one new can work until they are tested at least twice showing negative to all common STDs. Then I would not see a need for condoms.

      rh... I don't think lying about status is an issue... I thought hey all are required to have tests on file and I think they have to be tested very regularly. I don't know all the specifics, but I remember reading they have to take the HIV test that is supposed to go positive a short period after exposure. And they have to have a recent test before working. There is always a window of risk, but they try to make it as small as possible.

    Anyone who has worked in a factory has been required to wear safety googles, hard-toe boots and even hard hats; anyone who has worked in a hospital or clinic has worn latex gloves and masks: many work places have safety requirements so this is not as 'invasive' or 'ridiculous' as some are protesting.
    That said I don't care if these people are stupid enough to take a risk, let them suffer for it; it's like driving without a seatbelt or riding a motorcycle without a helmet. It's darwinism and natural selection.

    Regardless of your religious stance everyone needs to remember that this is a business and it's about making money. Find a need and fill a need (literally).

    This condom law however while created with the best intentions actually will HARM the industry and their target audience will be affected.

    Men don't like condoms, we'll wear them sure.. but we don't LIKE to. Why would we want to see a porn film (which is basically a fantasy story) where there actors are forced to do the very thing we as men HATE to do?

    It makes no sense.

    I understand the safety aspect but the actors and actresses have made it very clear they do not want this type of interference in their line of work.

    20 years ago this law certainly would have been helpful, but times AND science and safety precautions have changed.. a simple test can prevent a disease just as easily as a condom can.

    mr. Dean has the right to express his opinion and made some valid points but in light of the recent AIDS scare in the porn industry condoms make sense. Sure there are porn viewers that would consider a condom a form of censorship but they also feel that hey, I'll never come in contact with these folks so what's the harm? Well the harm is that you don't always detect people with a common cold but you wind up catching it. This law may prove to be for the greater good as for as protecting the health of the general populace. Now the taxes and fees are another thing. That is just a overt way of raising revenue which with California's fiscal problems this just may be needed.

      It's about time we held everyone in the entertainment industry responsible for what they portray. If you're doing porn, you should set a good example by making condoms part of the script. Hollywood needs to make it clear that bad guys are not glamourous, they're simply evil. They need to show the bad part of using drugs, not just the fun part.       Actually he's pretty safe without this new regulation. They all undergo testing before and after each shoot to ensure that nothing's being spread and nothing's being contracted. This measure does nothing that's not already being done. I get that regulations in general keep people safer but we are very slowly turning into Oceania from 1984. Let people make their own decisions, and if they get sick or injured, that's their fault.

    How specific is the wording in the law? If it just says they have to wear a condom, couldn't they just tie the thing around their wrists or something and go at it? That's basically what a lot of bikers did when the helmet laws came out. It just said you had to wear one, not on which part of the body so they'd strap them to their arms and such and roll.

      There is a difference - the product construction workers create does not show their heads (or any part of them) - so whether they wear hats or not does not impact on the final product. Whether porn actors wear condoms DOES impact on their final product - the film. Los Angeles has banned the production of a large category of (legal) porn films.

      Assuming this ruling stands, it will not make the industry more health-conscious, because the real driver of an industry is sales. And condom porn does not sell as well, not by a long shot. If the ruling stands, the companies that want to make money will simply move out of Los Angeles... or go out of business.

It's always iffy and tense because you've got the stars working alongside someone who has a reputation for being shady and doing things many consider gross. There might be fear of catching a disease that could end a career or a life. And it could damage your reputation to work with someone like that.     The Occupational Health and Safety Administration (OSHA) requires the use of personal protective equipment for many, many other working people so that they can be safe on the job. Many of the employees who have to wear those protective devices don't like them; complain about them; feel persecuted when management threatens them if they don't wear them. This porn star is no different. There is nothing wrong with porn starts protecting themselves while filming and the resistence to it is no different that what any many other workers try to pull. All they have to do is learn to deal with it, as othe workers do. Or, maybe we need OSHA to enforce the general duty clause on the porn industry. They can do a few inspections while they're filming and start handing out violations.

      You said there is nothing wrong with porn stars protecting themselves, but that's not what this law is. This law is forcing a measure on an industry that actually doesn't need it, and that may be counterproductive to its purpose. The porn industry requires regular testing of its stars. They are self-regulated. Why should the government step in and take over that regulation (at the tax payers' expense) if the industry is already doing a good job of it? It would be one thing if there were rampant disease outbreaks and pregnancy issues in the porn industry, but there simply aren't. In addition, the whole industry is about promoting a fantasy, and sticking a rubber on it doesn't really help to accomplish that.

      These folks are independent contractors or free agents, usually...and the work place in question here is their body. Not a tremendous metal smelter, a bone grinder (pun intended), multi ton metal trucks carrying caustic materials......it is humans using their bodies with another human in a way they choose. This makes sense if you start charging everyone, everywhere, who does not use condoms with a crime unless they are planning for a child. Shoot, lets take all the risk out of it and only use harvesting and test tube techniques in a lab. Then, anyone catching VD ever must have violated the law and be punished. I argue that the adult entertainer of today with the hopefully rigorous testing standards is safer than those traipsing from bar to bar looking for the hookup. Unless they, too, are persecuted for not wearing protection, it is ridiculous to enforce a separate standard for the adult film 'star'.

      Enforcement would be very straightforward. If a film is released that includes male performers without condoms, (a) that film would be illegal to distribute (i.e. money to be made on it), and (b) the makers and performers of the film would face penalty according to the law. I don't necessarily agree with the law but enforcement seems clearcut to me.

      from what i have read on a few of these type of laws. way it works is. that enforcement fee is the salary of a site inspector. basicly. think of a construction site. having to pay the salarey of say a union safty inspector to stay on site during all working hours. there forcing them to employe a goverment employee basicly

    These days so many people hate big government but has no problem imposing it on other people. The porn industry has lots problems but this part of this bill does little to fix them. It does force a very profitable industry that people have enjoyed throughout the world since the dawn of time to relocate. I'm not saying condom use in porn is a bad thing, but I also understand that it doesn't sell. Porn stars are adults and in a free society they should be able to decide for themselves how they to be shown on camera. California is in a lot of debt and losing this revenue is not going to help grow their economy. The people need to look for real solutions to problems not create new ones.

      Los Angeles and California are about to run afoul of the law of unintended consequences. With the existence and proximity of Las Vegas, plus let's not forget CA has some of the highest taxes in the US, and Nevada has NO personal state income tax...

      I honestly can't imagine why that industry hasn't already moved there. Especially when you consider Nevada is already one of the who re capitals of the world, certainly of the US.

    This law is so stupid, porn starts know exactly what risk they are taking if they do not use a condom. The porn stars get tested more often than most health professionals and every porn star has to submit these test to the production team to protect everyone involved. These days you do not hear about porn stars contracting STD because the industry is very proactive in making sure everyone is safe and clean before they do movies with out condoms. I hope the industry does move to Vegas, we need a good boost to our economy and porn is a multi billion dollar industry. So come to Vegas and you will be better off, besides there is no personal income tax in Nevada so you get to keep even more of your money!

    I stopped reading after your statement about fearing death. I know no such fear. In fact, I frequently face death, sometimes very closely, while canoeing whitewater rivers. I live for today, and I do not concern myself with fairy tale "life in the hereafter" where its gonna be like Sunday School for eternity. THAT would be my personal definition of hell!

    Prayer and religion are for sissies that lack self-confidence and are unwilling to accept personal responsibility.

    This is exactly why the SpecEd schools are key! I attended the short-bus schools for many years, until they realized I was put into the wrong category. It wasn't that I was mentally handicapped, just socially retarded. I couldn't act properly around girls...they shunned my chunky frame. I ended up turning to the other team!!
