Racial bias suit filed against 'Bachelor'

A class action lawsuit filed in U.S. District Court on Wednesday accused ABC, along with an individual and the companies involved in production of "The Bachelor" and "The Bachelorette," of intentionally excluding people of color from lead roles on the shows' past 23 combined seasons.

The complaint alleges that ABC and the other defendants have only hired white applicants based on "the calculation that minorities in lead roles and interracial dating [are] unappealing to the shows’ audiences...a conscious attempt to minimize the risk of alienating their majority-white viewership and the advertisers targeting that viewership."

The suit was brought by Nathaniel Claybrooks and Christopher Johnson, two African-American men living in Nashville who applied to be on “The Bachelor” in 2011.

Johnson alleges in the complaint that when he went to a casting call for “The Bachelor,” he was denied the typical application process. He said his application materials were taken by an employee of the defendants named in the suit; the same wasn’t done for other apparent non-black applicants he saw.

Claybrooks alleges that at his casting call for the show he was interviewed for less time than white applicants, rushed through the process, and therefore not given the same opportunity as the white applicants.

The complaint asserts that “Both Mr. Johnson and Mr. Claybrooks were well-qualified to become the next 'Bachelor'” as they are “outgoing, personable people who are upstanding members of their community." Thus, the complaint alleges "upon information and belief" that "their applications were never seriously considered by defendants because of their skin color.”

In addition to Claybrooks and Johnson, the complaint was filed on behalf of all other people of color who’ve attempted to land “the role of the 'Bachelor' or 'Bachelorette' but [have] been denied the equal opportunity for selection on the basis of race,” as the lawsuit alleges.

The complaint goes on to posit that neither “The Bachelor” nor “The Bachelorette" has featured “a single person of color – whether African-American, Latino, Asian, or any other minority race or ethnicity — in the central role." Put another way, “in 16 seasons of 'The Bachelor' and 7 seasons of 'The Bachelorette,' every person featured in the lead role on either show has been white.”

The complaint also alleges that there are few people of color chosen to compete for the affection of the “Bachelor” or “Bachelorette,” and when there are, they tend to be eliminated early.

It claims that "the absence of a Bachelor or Bachelorette of color over 23 seasons is not due to a lack of qualified applications from people of color. Rather, minority applicants are purposefully provided less than an equal opportunity on the basis of race."

ABC declined to comment on the suit, while another defendant, Warner Horizon Television, called the complaint "baseless and without merit" in a statement to CNN.

The production company says they've had "various participants of color throughout the series' history, and the producers have been consistently – and publicly – vocal about seeking diverse candidates for both programs. As always, we continue to seek out participants of color for both 'The Bachelor' and "The Bachelorette.'"

(Warner Horizon Television is one of the production companies for "The Bachelor" and "The Bachelorette." It is part of Warner Bros. Entertainment, which is owned by the same parent company as CNN.)

The other defendants named in the suit include the shows' executive producer, Michael Fleiss, Next Entertainment and NZK Productions.

The plaintiffs are seeking punitive damages on their behalf, as well as for those who fall under the class, in addition to an injunction mandating that ABC and the other defendants consider non-white applicants for the two lead roles and develop policies to ensure casting occurs without consideration of skin color.

    Ok this show is the definition of "white trash",I don't understand how much respect you can even have for yourself to go on national television and essentially sleep your way to finding you true love! The relationships never last, these white people come with so much baggage (and yes Emily your daughter is baggage and a way to win the audience over) and say "ohh lord I'm looking for the one!" While I do think diversity is great I don't think its in good taste to have a person of color on the show.

    so many negative comments :( the point here is that this is reality tv and the producers are giving a very specific niche audience what they want. also, did anyone stop to think that maybe if they pick a white guy to be the bachelor that he doesn't like black, asian, hispanic, whatever women- how ridiculous would it be to pick a man or woman to be on the show and then throw them in with a bunch of people they aren't even physically attracted to. it is a good point that they probably should have had a black bachelor or maybe an asian bachelorette, but again the target audience for this show is 25-65 year old white women, typically housewives, who want to watch an attractive "prince charming" type guy or an "everywoman" meet someone. filing suit against the bachelor is just as silly as some white model suing ebony or jet for not putting her on the cover or booking her for a spread, or some asian guy being mad that telefutura or univision didn't hire him for their newest novela- some on people, it's a tv show- yes, racism is wrong, but looking for it everywhere is just as bad

      The arguments here are just insane. Amanda, the Bachelor may have a target age range. Whether the execs are open about a target race is debatable. Obviously more than white women watch the show. There's no open labeling on the show that states it's only for white women to watch. Therefore, the show opens itself up to this criticism. And no, it's not the same as an asian guy suing telemundo or a white model suing ebony. Those examples are clearly labeled as targeting one racial/ethnic demographic- either in word or print. Google Ebony and you'll see it says "premiere online magazine for African American cultural insight." The Bachelor does not use such labeling.

    The premise of this lawsuit is that the application by the defendants is the same as an application for employment, it is not. The appplication is background information for entertainment purposes only. Since there is no guaranty of compensation for the applicant volunteering their time for a chance of appearing on a TV show, the application is not covered under Federal Labor Laws. Not sure why the Lawyers would pursue this complaint except for the publicity.

    Just when you think the nation has progressed you read comments like these that make you disappointed in modern society. The lawsuit may seem ridiculous but really all the men are looking for is equality in all of its aspects. All they wanted was an equal interview to their white counterparts not to be taken automatically as a "token black person" on the show. Its quite sad to see how so many people remain ignorant and racist to this day. the issue is not whites vs. blacks it's ignorant vs. educated and it does'nt matter what race you are for you to be ignorant as can CLEARLY be seen in a majority of these comments.

    Hmmm....What would happen if we had a television station called WET, White Entertainment? Yet BET is supported. I am sure one can argue we do not have to blanatly name a station WET because based on the programming and lead actors of the existing networks, they already exist. Individuals should advance based on their merits and their own motivations, not based on what ethnicity they may be. No one will deny that discrimination and as well as reverse discrimination occurs. Before one blames their outcome based on the ethnicity they are not, one should have deep introspection and ask themselves, Am "I" doing everything "I" possibly can do succeed in this situation. If things don't turn out as you had hoped, think long and hard whether you want to put the blame on race.

    isnt the point of the show to portray a bachelor with qualities that women love? How is it going to look by showing a black bachelor on food stamps driving a $200 car with $5000 wheels and no insurance? Yeah, women want that........and the bad part of my statement is that I am african american and feel that this is how white america sees us. We have been doing this to ourselves. The slaves days are over, equality is out there, you have to go get it just like everyone else.

    As mentioned, and worth repeating....

    Its all about rating. The show had blacks, but they were eliminated early because there wasn't any significant number of viewers who liked them. If more blacks watched the show, and supported the black contestants, then things would be different.

    If these guys really want to sue someone, they should sue their fellow blacks for not watching.

    They are creating a product. A product they have to sell to 2 separate customers. 1. they have to sell it to the audience and 2 they have to sell it to the advertisers. Advertisers want a middle class white audience and in order to get that they have to cast the show to attract that audience. It's just business. This lawsuit is ridiculous. Why doesn't he try to develop a Bachelor like show for BET or something. Instead of suing, he should make his own opportunities. That is, or I should say used to be, the American way.

    What are they going to do? Make the choices for the bachelor/bachelorette? They want ratings. So they chose people who are going to bring in those ratings. If their ratings drop then the show will end. If the show ends then NO ONE gets to be the bachelor/bachelorette.

They haven't had the token black girls on in 9 cycles of this show, and black men, even the light brother was never seen. Yes we have been a ainbow nation for two hundred plus years but for some it will always be too soon to show Becky kissing Jamal in prime time on a Monday, Perhaps Gentlemen you should explore why you have a need to debase yourselves on a reality tv show. The only ones getting rich from this friviolous lawsuit will be the lawyers.

    Good grief! I'd be willing to bet big $$$ that no white woman (or man for that matter) has ever been asked or allowed to participate in Miss Black America either but we're not crying foul about it. They probably wouldn't even provide the courtesy of allowing a white contestant to apply or interview for it. Additionally, after the 1st round, shouldn't it be the contestant's choice as to who makes it to the next round? Attempting to guarantee a balanced mix would only make an already unrealistic show that much less appealing.

      I think it is probably a majority of white people that watch the show so it is a majority of white people that apply for the show. Just because you weren't picked to be on the show doesn't mean it was because you are black. That is ridiculous, it is situations like this that cause racial problems in this country. I am going to cry because I didn't get something that I so clearly deserve or that is owed to me. I would say this show is probably pretty equal about who they discriminate against, never seen a fat person on there either of any color.

    Television is about ratings. If you don't have them, the show dies. Before everyone plants their protest sign in the ground, we should give it some time for the facts to come out. The article says that the two guys, from their prospective, were treated differently. However, it isn't clear that producers didn't dismiss quickly other candidates (of all races) just as quickly. Could be because they were ugly, unappealing, criminal backgrounds, or some personality flaw that didn't make good TV.

    I'm not a fan of this show so I can't say I would watch or wouldn't watch if there were a minority as the lead. I am sure that if I'm not attacted to the bachelortette then why would I care if she found a guy or watch the show.

    To compare a decision of hiring an attractive white bachelor(ette) to get the best ratings to hiring a minority to be in the sherrif's department is a poor comparison. I wouldn't hire a grundgy punk rocker with piercings all over to sell make-up in a departement store. I wouldn't hire a hairy old guy to sell pharmacuticals to a doctor. You make certain hires that are specific to looks and appeal. A clothing store that caters to blacks would probably be more successful hiring black sales people than white. Doesn't mean they wouldn't consider it, but if you owned the clothing store, you want the best sales possible.

    When our cultures diverge closer, then we as mutliple races will diverge and be able to get along better. It is our differences that we celebrate and fear.

They are just appealing to their largest viewing audience for that show which is 90% White Women!     I wouldn't really be too surprised if the network intentionally didn't choose a person of color. The network is going to put shows on the air that get ratings so that they can sell advertising. If the feel that a black man as the Bachelor isn't going to get good ratings, they won't do it. As it is, a Bachelor has a bunch of women to choose from and the majority of them are white. If the white person chosen as the Bachelor told the network that he only wanted white women to choose from, that is his right but it would certainly cause an uproar.

    It sucks if someone's feelings are hurt by the fact that they are excluded from becoming "the Bachelor" because they are black and it may very well be against the law, but suing isn't going to change people's feelings. If the network felt that a black bachelor or bachelorette would be get good ratings, they'd probably consider it. But they obviously don't.

    the "contestants" on the show are almost always attractive and rarely are they overweight. why? because people want to look at attractive people. The network obviously feels that their white audience wants to look at white people on tv. Again, I'm sorry if it hurts someone's feelings, but it is probably true.

    This isn't my personal feeling, just making a point here. I don't watch the bachelor or bachelorette – lousy shows filled with people that I wouldn't want to spend 5 minutes with.

    Notice how this is not about minorities getting a fair shot but about blacks. The main focus is always about blacks and never hispanics, asians, and god for bid american muslims, and gay/transgenders. Of course this law suit was filed by two blacks and no other minority. Even with the trayvon martin case though george is hispanic the media and blacks consider it a white on black issue.       LK2 I think you need to start watching some of Tyler Perry's play, shows, and movies. He has had blacks, whites, latinos, etc., in his productions. Should I add that caucasions love to watch Tyler Perry films. They fill up half of the movie theater when one of his movies comes out.     This lawsuit will get nowhere. The Bachelor and Bachelorette is a tv show. Like all tv shows, they want to appeal to the widest audience they can, and that means having a white lead with occassional minorities in the supporting roles. How is this show any different than any other television show? If you're going to sue the Bachelor for not having a minority star of the show...then you might as well sue the creators of Friends, How I Met Your Mother, Two and a Half Men, etc. Only a small percentage of shows with minorities in the lead role have been successful on a major network television...like the Cosy Show, A Different World, etc. Those types of shows are usually relegated to cable tv where there is a niche and those channels specifically target that audience. It's show business!

    Reminds me of here. If you don't talk like a f @g or talk about sh!t your not accepted. I have noticed that more n more ppl have left, not just the cc gang. I did find the place they go to now. Its wierd to, they ALL get along, the comments are funny, n they don't talk down on anyone. Made me relize how lame n ignorant this place truely is.
