Lindsay Lohan has barely settled into her 12-by-8 cell at a Lynwood, California jail and already she’s making plans to head home.
Los Angeles County Sheriff's Department spokesperson Steve Whitemore told CNN that “unless something unusual happens” the troubled actress - who was remanded into custody to begin her jail term yesterday - will likely serve 13 to 15 days (or 25 percent) of her 90-day sentence.
Whitemore adds that this is routine for an inmate like Lohan, who was convicted of misdemeanor probation violation in a DUI case and, in the state of California, is eligible for "good time/work time" credit (when an inmate serves their time in an acceptable manner).
According to People, the 24-year-old star will likely be confined to her cell for 22 hours each day during her stay at the Lynwood facility. She is denied access to the Internet and a cell phone, has to use generic grooming products and is not allowed to smoke.
It’s not all bad, however. “They watch 'I Love Lucy,' 'Wheel of Fortune,' and a local news channel all day long,” a jail insider told the magazine.

She is celebrity so she gets 15 days, overcrowding is an excuse. They make this excuse every time it is a celebrity and not a common person. Special treatment for special people, they are all above law, isn't it?

As someone the same age as Lindsay, I have to say that it is people like her who give people in their 20's a bad rap. I would like to see her be a wife taking care of 2 children under 2 while working full time for the military AND managing a house and happy marriage (all while her husband, who is also military, is deployed to Afghanistan). What is the point of sending Lohan to jail if she's only going to do 13 days? Seriously how is that going to help her? The reason why she's so bad is because she gets off easy everytime she breaks the law. I doubt that she's ever been disciplined by anyone, including her parents, in her entire life. No, the jails are overcrowded, it was a nonviolent crime, however, as a person in recovery, the best thing in the world for her wold be to be sent to a rehab that is long-torm and not cushy and where she really has to do some work on her self! I know a little bit about the places she has been and they are jokes. I was in a 3 1/2 month program where you could only make phone calls with your counselor present and it was the best thing that ever happened to me! This is what it is all about, not 13 days in jail. (If I had it) I would bet her a million dollars she will be high again a week after getting out of jail! Thank You.

LL has to report to rehab within 24 hrs of her release from the jail. The rehab facility is being selected based on her medical and psych eval conducted upon her arrival at the jail. No doubt it is one geared toward celebs but most rehab programs are kind of like being in boot camp.

Hey can anyone read person, if you think that the law is equal for the average joe or joesephina.. then you are dead wrong. It's not the overcrowding of the jails. If you commit a crime then you should have to serve your entire jail time like I did (by the way I was a model inmate) but I served 30 days and the judge ruled that I serve 30 days. That is it... the law is the law. If the judge says 90 days, then you serve 90 days cause that's what the rule book says. If we can bend and break laws because of our status in society or how much money we have, then the law is a joke
what was the crime that you served your time for and what state are you in? This is not the case in california and no one here serves a full sentance. I work in a county jail and we early release people all the time. If we had more jails this would not be the case but unfortunatley it is the case here in california

Time Off for Good Behavior
Did you know that inmates in the Orange County Jail rarely serve their entire sentence? Currently the jail offers one day off for every two days served for good behavior.
How hard is it to get time off for good behavior? Not very – all inmates are automatically given time off and must do something to actually lose their time off. These are usually very serious offenses such as excessive fighting, smuggling drugs in to jail or arguing with guards.
According to several former Orange County inmates there are constantly rumors going around that the time off for good behavior will be increasing due to overcrowding but these rumors are never true and have been going on for years. If you or someone you know is going to the Orange County Jail you can count on them either getting out 2/3 into their sentence or on appeal.

5 years ago I violated my probation on a DUI and drove to court on a suspended license (as I had no other way to get there), mind you I was stone cold sober... but the cops followed me out of the courthouse and locked me up for 30 days. I was not treated with any respect, no courtesy to get my affairs in order, no looking at my history with the law (as I had none) they just threw me in LA county jail for 30 days. Guess what I learned my lesson, never again will I break the law

Based on your logic the "average joe" that blew my uncles face off duringt a robbery would still be sitting in his prison cell since he was sentenced to life in prison so he automatically serves his full sentence. He was sentenced to life in 1987 and was paroled in 1997 and is walking the streets even now. Please tell me how 10 years served = a life sentence.
This has nothing to do with her being a celebrity. This is how the jail systems work for everyone in california. For non violent crimes you do not serve full sentences unless you cause problem or troble and do not get time off for good behavior. Our prisons are overcrowded and this is why she will be let out, she is going straight into rehab after this as well. People are such haters.
As one that worked as a Corrections officer in a large jail for many years I can say in my opinion her sentence is about right. People scream on one foot we should jail the real criminals but ignore the fact that no crime can go unpunished because why would anybody follow the law if small crimes were always ignored? That being said most jails ARE overcrowded and they Do want to make room for the "Real" criminals. So this young lady will go in for a few weeks and find out very quickly, nobody cares who she is and she is just another crook at that jail. She will wake up at about 5:30-6am eat a yummy breakfast, then kill time untill lunch....kill time untill dinner...go to bed and thats about it. Jail is not Prison and while it is dangerous it is no were near as dangerous as a prison with lifers as most jail residents are still going too court and on there better behaivor. Will she learn something from this? I doubt it since she has been blaiming everybody but herself but a little bit of self reflection never hurt anybody who knows.

Basically what it all boils down to is that the law is not equal for every man woman and child, the rich can get away with murder. If you can't trust the laws of your state to be fair with you, then you can not trust the country as a whole. I love this country, would not want to live anywhere else, but we the people are not equal and I have come to accept that fact... so should you.

I get that nobody likes anybody treated better than themselves... But, seriously, why does so many people hate Lindsay so much? She's not the first celebrity to use drugs, get DUI's and go psycho on others...! Off the top of my head I remember that; Britney Spears, Nicole Richie, Paris Hilton, Kloe Kardashian, David Hasselhoff,Alec Baldwin, Downy Jr., etc... have gone through similar situations and people don't feel such hate against them!
I think Lindsay is mostly destroying herself. Yes, it's really sad, but at the end of the day it's her freaking life and she can do with it, whatever she wants.

Calif has money problems. The problem for a judge giving someone a sentence–(for instance) 90 days. Now the word is out-she will only serve 23 days (good behavior?). Now the convicted person will serve 13-15 days. Does this encourage people to respect the law and our courts? The law is a game of "let's make a deal! Behind door #1–13 days! What a farce! Excuse- the jails are overcrowded (we've been hearing that for years). Maybe, prisoners need room mates. Maybe Calif. needs a tent city. Handling sentences like this is not a deterent. It just makes offenders arrogant.
Ok. I have two points..
A. I thought time off for good behavior was 1/3 of sentence time.. but maybe that fluctuates per city or jail. depending upon overcrowding etc.
b. We should really consider.. if its really worth it to spend all of the cities money on courts.. da time etc.. on something that in the end is going to give 15 days.
just get her out of jail, i don't want to pay taxes to keep her pent up, the Judge should give her a stiff monetary fine . Lohan has plenty of money and can afford to pay a big monetary fine and just go on and do what she does, if she does more illegal stuff, just bring her back to court, find her guilty, and access her more money as much as the law allows. I dont really care what she does , just dont need for me to pay taxes to keep a wealthy person in jail for nothing.

She violated her probation how may times.... she was wearing an ankle braclet that did not even stop her from drinking...now she is only serving a meer two weeks... no wonder she thinks this is a joke and can get a way with everything casue she does... SHE IS THE JOKE
Ingorant people. She is not in jail because of a DUI. She is in jail for a probabtion violation (for not going to drug treatment) The probation was ordered as sentence for her DUI which is normal for 1st offense. That is all she is convicted of.
The courts need to teach these people a lesson. For those of us who are not celebrities, we are not given any special treatment and serve what ever the court dictates and so should they. This is to the judge, I vote to make her and all celebrities serve whatever sentence they are given. Spoiled little rich girl, get a life... hope she has to work in the laundry... Oh, what am I saying, poor little rich girl will cry her way out of working.
Since you are voting on crafting a new rule that would regulate everyone under it, then you need to clear up any ambiguous terms that could be confusing to the court. Could you please articulate your definition of "celebrity." Remember, you want all people to be treated equally, so you need to have a definition that will lack ambiguity. What criteria would you recommend to determine if a person is a celebrity in the eyes of the law?
This girl needs help from a treatment center..her family also needs help for thier denial of her problems. Sadly, this will continue becuase no one cares about her over all health (mental, physical, emotional) Maybe she will get help – look at Britney Spears she finally got the help she needed. there is always hope i guess

Maybe this should serve as a wake up call to those curious about WHY the California prisons are overcrowded. We have a population that is exceeding our resources and infrastructure, and there are so many laws on the books that everyone is a criminal at some point in their life. Police arrest people for breaking the law and so they are just doing their jobs, and aren't responsible for overcrowding. Prosecutors go ahead and prosecute law breakers and say their just doing their jobs, and aren't responsible. Judges hand down mandatory minimum sentences and fail to take responsibility. The legislature keeps making new laws to make more activities criminal, they are protecting everyone though and are certainly not responsible.

Of course she gets special treatment! Celebs always do! They can do NO WRONG! Look at any case where a famous celeb has broken the law, they do not get the same punishments as the rest of us would. Broken government, broken judicial system.

This is similar to when the media fixated on Robert Downey Jr. All the mean spirited losers take joy in celebrities downfalls. I guess it helps them take the focus of off their empty unproductive lives. Hopefully she will get a lesson from this whole scenario and straighten her life out. Kid's with money that like to party. Go figure.
Our justice department is a joke. Do you really think two weeks is enough time for a self centered person like Lohan? She doesn't take life seriously at all. Its up to the judge to show her that its not going to be her way, anymore.

I did say in another post that Lindsay would probably stay in jail no more than 20 days according to Hollywood standards. Justice is truly blind!!
My brother got a DUI in CA. And believe me he did about 50 days, and DID NOT get out due to overcrowing. This is just the excuse they use to tiptoe around the issue of treating the rich and famous better than the rest of us.

When we lived in CA my ex-wife rolled our car while drunk driving. We went into the court room for her DUI case there were literally hundreds of people on the docket. The court clerk stood up with a huge list of names read off about 30% of the total names on the docket (my wife's included) and said if we just read your name you can leave ... case dismissed. The prisons and court systems are flooded with DUI cases. This is not preferential treatment this is typical .... esp in CA.

Legal Bureaucracy, Trash Media Industry Out-of-Control- – – – Lohan's lawyer demonstrated she was trying to achieve probation while remaining employed. All drug tests have been negative over her entire 3-year probation. This was mostly ignored because the prevailing opinion (created by the trash media to sell stories), is a spoiled celebrity who parties. Of course the Legal Bureaucracy always wants to send a message (more budget please).
I have heard that spending one night in jail can be a nightmare - maybe the 13 days will take her to where she needs to be :out of the clubs & into rehab. Peace
Is she a threat to society in any way? No, besides the fact that we are all sick of hearing about her who cares. Like many have already stated this is not celebrity treatment, the jails are over crowded and why should tax payer money be spent in having her stay any longer than is needed, CA has enough budget problems without having to pay to take care of a celebrity for three months.

Whitemore does some interesting math...25% of her 90 day sentence is 22.5 days. It does seem as though the rich and/or famous do get preferential treatment.
wow, can't you people read, this is not celebrity special treatment, it is the standard deal for non violent probation violations for convictions like DUI, LIKE ANYBODY ELSE she will get the rest of her sentence suspended if she behaves and will be released on probation now with a taste of what it's like to be incarcerated and a renewed motivation (the point of locking her up) to stick to what the judge has assigned her, jails are over crowded and are stupid way of dealing with public health issues like drunkeness anyway, CA and most other states can't afford to keep people locked up for long periods of time just to make you feel better

Its not ridiculous... The article made a point of saying this was pretty common in cases like Lohans. (misdemeanor probation violation in a DUI case,) Infact my cousin (who isnt the brightest bulb on the tree) also violated his probabation and was sentenced to 60 days in jail. He stayed for 15 days with good behaviour and was released. And he isnt famous or rich, he's just a nobody from Rhode Island.
Probabtion violations are often in minimum security prisons. My cousin said the same thing, he watched TV and ate lousy food for 15 days and went home.
I mean what do you want them to do? Put her in a maximum security penitentiary with murderers and violent offenders for 3 months?
Brightest bulb on the tree?? Must run in the family. And it might do her some good to be in prison for a while-show her where she'll spend the rest of her life if she kills someone while she's driving high and/or drunk.
Maximum security sounds good. Maybe then she would get the idea that all of this is not a joke.

Nobody said it has to be in a maximum security prison. She had her chance already with probation, which she violated several times so she deserves to serve the full 90 days (which IMO is a fair penalty). Serving only 10 to 15 days isn't much of a punishment.

Why are celebs treated like royalty? I think the tramp should spend the whole 90 day sentence in jail. She's not getting out because of over populated. She's getting out because of money. Celebs get away with murder. Its not fair for normal people. We are just as good of people as they are or better. I feel sorry for all the celebs when they meet their maker. It's ridiculous!!! This great nation of ours smells like a big ol pile of dung when it comes to celebs.

I've known people who could do 90 days standing on their head. For someone like Lyndsay Lohan, two weeks will be enough. If not, she'll be back for more. Paris Hilton was out of control, went to jail and look at her now: Has she been back? No. Why not? Because jail isn't fun. The mere fact that she's actually in jail – and isn't going anywhere – has got to be her world turned upside down. There are people out there, hardened thugs, who've been in and out of jail so often, they'd consider two weeks some kind of vacation. But to go from Disney's darling to this has got to be a life-altering experience. in fact, to go from Cannes to this has got to be a wake-up call. And if it's not, someone page Dana Plato in the afterlife: Her new roommate is on her way.
Ridiculous. Why do celebrities get treated with kid gloves? She has repeatedly broken the rules, ignored the consequences, and will again. Jail and rehab are exactly what this befuddled 24 year old needs, and deserves. If I got treated like this I'd think jail was a joke, too! Absolutely pathetic.....
This is not treating her like kid gloves. Its the Sherrifs discretion how long she stays not the courts. This happens all over the US because of over crowding and has nothing to do with the fact that she is a celebrity.
2 weeks is not enough time for her to get the drugs and alcohol out of her system. How can she recover if she is not punished. Seriously, these kids need to learn a lesson. Here is a great opportunity and you just slap her on the wrist. What does she need to do next? Murder someone? pay attention to her cries. she may only be 24 but she is still young and naive. and needs to get it straight and she needs to get away from her enabling mother.

The jails are overcrowded. If they need to deal with that situation by letting people out early, so be it. I would rather see violent criminals kept in jail for their full sentences vice the non-violent offender a mob wants to persecute as an example.
deni you are absolutely correct, 5 years ago I violated my probation on a DUI and drove to court on a suspended license (as I had no other way to get there), mind you I was stone cold sober... but the cops followed me out of the courthouse and locked me up for 30 days. I was not treated with any respect, no courtesy to get my affairs in order, no looking at my history with the law (as I had none) they just threw me in LA county jail for 30 days. Guess what I learned my lesson, never again will I break the law

Why do we, the public, the media, think that we CARE about this girl? she is nothing but trouble, a tramp and a liar. It has gotten so that we think we have to know Everything that is going on in the lives of useless people like her. We need to concentrate on the people that do wonderful things in life and give as a human being. Not useless garbage.
If she is allowed to leave after two weeks in jail, she then needs to be court-ordered to rehab for the balance of the 90 days. It takes at least that long for any impact. This is not punitive; it is an attempt to help a very young woman survive her addictions. Her age may have been preventing her from understanding the magnitude of her situation. She has developed inappropriate coping mechanisms as a result of her exposure to "too much ~ too soon".
oh wow another star getting coddled, if i was sentenced to 90 days id be there atleast 60 to 75 of those days. what a crock. must be nice to be famous so people can feel sorry for you. they make mistakes over and over again and never have to pay. I make one mistake and im locked up. what a bunch of bull.
Am I the only one who caught that 13-15 days is NOT 25% of 90 days? Twenty five percent of 90 is 22.5 days.
Sorry to break it to you but very few offenders – to include murderers serve their full sentences. From the time you walk through the door you're getting credited time for "good behavior" which substantially reduces the amount of time spent there. Our jails and prisons are overcrowded and the offenders who have committed non-violent offenses are going to be the first ushered out the door. Those who serve the full sentences are usually the most violent and least cooperative prisoners.
FYI – in the case of people sentenced for murder the average sentence is 381 months (31.75 years) and the average time served is 178 months (14.33 years) – this means even a murderer will only serve approximately 46% of the actual sentence. So having L.L. serve less than 25% of the sentence isn't unusual, it's the reality of jailhouse math.
Celebrities are usually non-violent offenders. Of course, some celebrities get tougher sentences: Look at Wesley Snipes. He's going to federal prison for tax evasion. He won't be out after serving 25% of his sentence.
Justice system is a joke especially when it comes to actors, political members, and sports stars. Equal rights for all should be observed instead of ignored in our court systems.
She's not getting special treatment. It's common that misdemeanor offenders are given the chance for early release with the option of serving their remaining sentence through work programs or community service. I speak through experience, both personal and through the experiences of close acquaintances. They seem to do this mainly not because they necessarily feel sympathy for the offender, but simply because jails and prisons are heavily overpopulated, and housing non-violent offenders is not a priority in the correctional system.
Also, @Janice, Recovery isn't punishment. It can be, but if done the right way, it shouldn't be. You have to remember that addiction is a disease, people don't make conscious decisions be afflicted by diseases. Do you know how many illicit drugs circulate in the prison system? Often times, drugs are more accessible in jail than they are on the street. The most effective method of recovery isn't through jail time, but through professional guidance and support groups.
If this prison is so overcrowded send her to one that isn't. Lindsay should have to serve her full 90 days in jail and then the full 90 days in rehab. I also think that she should not be allowed her "prescription meds" since that seems to be a source of addiction for her. I don't understand why celebrities get treated like royalty. They are NOT royalty and the only thing special about them is that they have money and do stupid things. Any normal person to pull what she has pulled would be having it a lot worse than Lindsay does.

My sentiments exactly. It's unfortunate that there are such double standards in our legal system that uphold such actions. I have seen how some celebrities get a free pass because they enroll in a substance abuse program or some addiction program for the wealthy and get a slap on the wrist. When in actuality these programs do nothing but provide an enabling environment that does nothing to combat the real problem of addiction. I'm all for giving a person the benefit of the doubt. I'm all for second chances but sometimes people take kindness for weakness and run with it. I don't believe there will be any change in this young ladies behavior because once she's out she will be back in the environment that led to it all in the first place.
To all that think Lindsay is gettting special treatment: she is. Most women on a probation violation would serve around 72 hours due to overcrowding in the jails. Since it is not a violent offense, there is no reason to keep them longer. She will probably end up with two weeks because the cameras are rolling, even when the judge tells them to stop. She will have to serve her full 90 days in rehab. Hopefully she will get back to Shapiro's facility where he might keep an eye on her. Instead of complaining about Lindsay how about working to reform drug laws so that addicts get help and dealers and predators get locked up?
You cannot "punish" someone into sobriety. She is going to have to want to sober up for herself. I speak from experience. She needs her a** whipped some more by drugs and alcohol. Maybe then will she be willing to change.
She looks like she is on something and Lindsay should go straight to rehab to see what it is. Too many people are in jail.
The fact of her celebrity puts a strain on everyone at the prison. People offer guards $$ to photograph her, other inmates want to **** her or beat her up, the phone rings constantly, and she probably whines constantly for a smoke. They will be glad to see her leave.
